Deckers cares about your privacy. In this Privacy Policy, we describe how we collect, use, and share information we collect about visitors to this website, as well as our other websites (collectively, the "Site") and the services available through our Site, mobile applications, chat, and wherever else we interact with you (collectively, the "Services"). Some features (such as the ability to purchase) are not available across all of our Sites; please contact us if you have any questions.

This Privacy Policy applies to information we collect about you in our stores, through the Site and Services, and wherever we interact with you. WHAT ARE OUR SOURCES OF PERSONAL DATA?

We collect data from the following sources:

We collect data directly from you. We collect contact information, financial information, and certain identifying and demographic information directly from you.

We collect data about you from third parties. We collect your personal data from third parties, such as social media websites and data cooperatives. We may collect your identifying information from Facebook in accordance with its terms of service and privacy policy. We purchase and share contact information, demographic information, commercial information, and information about your internet and electronic activities from data cooperatives and other third-party data aggregators.

We passively collect data from you. We passively collect information about your internet or other electronic activity using tools such as browser cookies, web beacons and pixels, SDKs, and other similar technologies. Combining Data
We may combine data you provide to us online and in our stores. We may also combine this data with publicly available information and data we receive or cross-reference from third parties. We use this combined information to enhance and personalize your shopping experience with us, to communicate with you directly about our products and events that may be of interest to you, and for other promotional and commercial purposes.

DOES DECKERS SHARE THE DATA COLLECTED ABOUT YOU?

  • Service Providers/Agents. We share your information with third parties, including service providers, independent contractors, and affiliated companies, who perform functions on our behalf. Examples include: order fulfillment, package delivery, sending mail and email, removing duplicate entries from customer lists, data analysis, marketing and advertising assistance, advertising and analytics companies that collect browsing and profile information and may offer advertising tailored to your interests, providing search results and links (including paid listings and links), and credit card links. We provide such information to third parties solely to enable them to perform these services and functions on our behalf. These third parties are contractually obligated to protect your personal information from unauthorized access and disclosure.
  • Retail partners. Our product lines are offered internationally with selected international retail partners. The use of your personal information by our retail partners is subject to this Privacy Policy.

  • Select Partners. From time to time, we may enter into a business relationship with other individuals or third parties whom we consider trustworthy and whom we have asked to confirm that their privacy policies are consistent with ours. WHAT ABOUT THIRD-PARTY ADVERTISERS AND TRACKING MECHANISMS?

We use third parties such as network advertisers and social media platforms to help us advertise. This includes displaying our ads on other websites and through social media platforms. Our network advertisers and other third parties may also help us determine relevant advertising on our websites. Network advertisers are third parties that display ads based on your visits to our website and other websites. This allows us and these third parties to target advertising by displaying ads for products and services that are likely to be of interest to you. DO YOU TRANSFER MY DATA OUTSIDE MY HOME COUNTRY?

RIGHT TO INFORMATION, RIGHT TO ERASURE AND RIGHT TO RECTIFICATION

You can ask what personal information we have collected, used, shared and sold.

You can also request that we delete your personal data. However, we may not be able to delete all of your personal data if one of the following exceptions applies:

  • Transaction-related: To complete a transaction for which the personal data was collected, to provide a good or service you have requested, or to fulfill a contract with you,
  • Security: To detect data security incidents, to maintain the integrity or security of systems, or to investigate, report or prosecute those responsible for such acts,

Please note that if we delete your personal information, many of our services will no longer function in the same way. For example, your loyalty points and rewards will expire, your previous opt-out requests will not be saved, you will no longer have an account or order history, and saved preferences and information will no longer be available.

You can also request that we correct certain inaccurate information we have about you.

To exercise your right to access, erasure, or correction, you can call us at 866-998-7826 or email privacy-compliance@deckers.com and follow these instructions:

  • In the subject line of the email, state “Right of access”, “Right to erasure” or “Right to rectification” as well as your country of residence and
  • Please provide sufficient personal information so that we can locate your records and verify the identity associated with your account. At a minimum, you must provide the full name and email address associated with your account. We may request additional information to complete the verification process if we cannot initially verify your identity. Our ability to locate your personal information is limited by the accuracy and completeness of the information you provide.

To appoint an agent to act on your behalf, you must provide the agent with written permission, and your agent must provide this written verification at the time they make the request on your behalf. If you wish to make multiple requests under this section, we recommend that you submit your deletion request last, as we will not be able to fulfill your other requests once we have deleted your data. We will keep a record of your request. If you would like to correct your data more quickly, you can do so yourself within your website account.

MY PERSONAL DATA MAY NOT BE SOLD OR SHARED/USED

Personal information we sell or share/use for targeted advertising

Under California law, "share" means that we share your personal information with third parties in exchange for money or something of value for cross-context behavioral advertising. Therefore, when we use the term "share" in this section, we do so in the limited sense as defined under California law. Other state privacy laws do not use the term "share" but instead use the concept of using personal information for targeted advertising.

Under California, Colorado, Connecticut, and Utah law, "sell" means we may exchange your personal information with a third party for money or something of value. Under Virginia law, "sell" means only the exchange of personal information for money.

Through our participation in digital advertising networks and in conjunction with our Select Partners, we may sell or share/use the following categories of personal information for targeted advertising:

  • • Internet activities/electronic activities,

We do not knowingly sell, share, or use personal information of minors under the age of 16 for targeted advertising.

Right to refuse the sale or sharing/use of your personal information for targeted advertising

You may opt out of the sale or sharing/use of your personal information for targeted advertising for online activities by using our Cookie Preference Tool to disable "Marketing and Social Media" cookies, or by enabling a browser or plug-in opt-out signal that makes it clear that such a signal is intended to prevent the sale and sharing of your personal information. Note that if you delete your cookies, your opt-out request will no longer be saved for that browser. To appoint an agent to act on your behalf, you must provide the agent with written permission, and your agent must provide this written proof at the time they make the request on your behalf.

We will not “sell” or “share” sensitive personal information (as defined in government data protection laws).

RIGHT OF OBJECTION

If you are a resident of Colorado, Connecticut, or Virginia and we were unable to comply with your request, you may object to our response by emailing us at privacy-compliance@deckers.com within fourteen days of our decision and submitting a request to object, including your name and contact information, a detailed explanation of your objection, and your state of residence.

SENSITIVE PERSONAL DATA

We do not collect or process sensitive personal information, as defined in the California Privacy Act, to infer characteristics, and we do not use or disclose sensitive personal information for any purpose other than as permitted by law.

FINANCIAL INCENTIVES

We offer various financial incentives. The terms and conditions of the financial incentive will be communicated to you upon registration. You may opt out of any financial incentive by calling 866-998-7826 or by unsubscribing from our email marketing by following the link at the bottom of each marketing email. The value of your data corresponds to the value of the offer presented to you. We calculated the value of the incentive based on the costs associated with the offer.

PROTECTION AGAINST DISCRIMINATION

We will not discriminate against you because you exercise any of your rights under federal privacy laws, and we will not deny you goods or services, charge you a different price, or provide you with lower quality goods or services because you exercise any of your rights.

You will not have to pay a fee to access your personal data (or to exercise any of your other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with the request in these circumstances. We aim to comply with all legitimate requests within one month. It may take longer than one month if your request is particularly complex or if you have made multiple requests.

HOW LONG DOES DECKERS STORE MY DATA?

Your personal data will be deleted when it is no longer needed for the purpose for which it was collected.

Your data, which we need to manage you as our customer, will be retained for as long as you are our customer. If you choose to terminate your account, your data will be deleted in accordance with our policy, unless otherwise required by law. We may need to retain some transaction data for evidentiary purposes in accordance with applicable law.

We will not retain consumer information used for prospecting purposes for longer than 3 years from the date of last contact with the prospective customer or the end of the business relationship.

We will not retain data collected through cookies and other trackers for longer than 24 months without renewing our notice or, where appropriate, obtaining your consent.

Some other data is retained only for as long as necessary to provide you with the relevant features of our websites or apps. For example, your geolocation data will not be retained beyond the time strictly necessary to identify your nearest store or to confirm that you were present at a particular location at a particular time.
